Industry clean-up starts at Japan ERI

The land ministry Thursday started a series of inspections to
determine the extent of incompetence, inadequacies and possible
corruption in an industry sector responsible for the safety of
people's lives.
Twelve inspectors of the ministry's Housing Bureau started searching
Japan ERI Co., the nation's largest building inspection company, in
Tokyo's Minato Ward, at 9:30 a.m.
The ministry wants to determine why the company failed to act on
a warning in 2004 that former architect Hidetsugu Aneha had faked
a structural-strength report for a building in Tokyo.
The ministry also wants to know why Japan ERI approved subsequent
strength reports by Aneha for seven now-completed buildings, including
a condominium complex in Kawaguchi, Saitama Prefecture, that are at
risk of collapsing in a moderately strong earthquake.
The ministry conducted similar inspections last month on eHomes Inc.,
another inspection company that missed Aneha's falsifications.
But given growing public concerns about the quake-resistance levels
of buildings, the government decided to extend its investigation
beyond cases involving Aneha.
All 123 building inspection companies or organizations in the private
sector will be checked to ensure proper inspections and safety measures
have been taken.
Building inspections used to be conducted only by local governments.
In 1999, however, private-sector organizations were allowed to enter
the field as part of deregulation of government work.
As of Dec. 1, 123 private companies or organizations were in the
building-inspection business. By the end of the month, the Ministry
of Land, Infrastructure and Transport will have inspected the 50
private inspection organizations designated by the central government,
officials said.
Prefectural governments will inspect the 73 other companies that
were designated on the local level.
Some experts say these private-sector companies have a difficult time
being objective in their inspections. That is because real estate
developers are not only the inspection companies' clients, they are
often their shareholders.
"We do not believe that private (inspection) companies, which are
seeking profits, can maintain a fair and neutral stance in their work,"
said Makoto Furohashi, chairman of the land and house subcommittee of
the Japan Federation of Bar Associations.
Five housing companies are large shareholders--as well as clients--of
Japan ERI.
A Japan ERI official said there are no conflicts of interest.
"We have a supervision committee that consists of outside experts,"
the official said. "They check our businesses. Therefore, we can never
offer favors to our shareholders."
The question remains over why six building inspection organizations,
including Japan ERI and eHomes, failed to stop Aneha's fake reports
from being used to construct at least 42 buildings.
A different architect, Tomoyuki Watanabe, said he warned Japan ERI in
April last year that Aneha had committed obvious fabrications in a
structural-strength report.
However, Japan ERI did not make public the falsifications, allowing
Aneha to continue working--and faking strength reports--for another
year.
"We will completely cooperate with the ministry's inspections," Takahide
Suzuki, the Japan ERI president, said in a statement. "By doing so, we
want to regain the people's trust in our company."
Japan ERI employs 165 building inspectors, including 102 who had worked
in local governments.
Other companies said they do not have the manpower to keep pace with
the demand.
"We have no other choice but to employ people who worked as construction
superintendents in local governments," an official said.
Aneha said he faked the reports because companies demanded a reduced
amount of construction materials.
A Lower House committee has decided to summon Aneha as a sworn witness
to get to the bottom of the scandal.
